Terms of Service

This is a translation of the German original. In the event of any discrepancy, the German version shall prevail.
1. Scope
These Terms of Service apply to the use of the aincare app, the aincare browser service, and the website aincare.de, operated by Clemens Krainer, aincare, c/o Block Services, Stuttgarter Str. 106, 70736 Fellbach (hereinafter "aincare" or "we"). These Terms apply to consumers and businesses unless expressly stated otherwise.
2. Service Description
aincare provides an AI-powered assistant for senior citizens. The service includes:
- Text and voice communication with an AI assistant (Google Gemini)
- Information search and everyday assistance via integrated Google Search
- Conversation history and archiving (with registration)
- Optional guardian area for family members (in development)
Important notice: You are communicating with an artificial intelligence system, not with a human being. aincare is designed as an everyday companion and does not replace professional medical, legal, or financial advice. AI responses are automatically generated and may contain errors. For health concerns, please consult your doctor; for legal questions, consult a lawyer.
3. Registration and Use
The basic features of aincare can be used without registration. For advanced features such as conversation history and synchronization, optional registration via email or phone number is required. A minimum age of 16 is required for independent use (§ 8 DSGVO in conjunction with Art. 8 GDPR). By using aincare, you confirm that you are at least 16 years old or have the consent of a legal guardian.
4. Guardian Area
aincare plans a guardian area through which caregivers can manage appointments, medications, and subscriptions for the person in their care. Caregivers will not have access to conversation histories. The person in care retains full control over their conversation data. We will provide separate information about the availability of this feature.
5. Terms of Use
Use of aincare is subject to the following rules:
- The service may not be used for illegal purposes.
- No automated access (bots, scraping) is permitted.
- Login credentials may not be shared with third parties.
- Use is limited to personal, non-commercial purposes.
- You may not present or distribute AI responses as professional advice (medical, legal, financial).
6. Availability and Liability
aincare strives for high availability of the service but does not guarantee uninterrupted access. Maintenance work and technical disruptions may lead to temporary restrictions.
aincare is not liable for the accuracy, completeness, or timeliness of AI-generated responses. Liability is limited to intent and gross negligence. Excluded from this limitation are damages resulting from injury to life, body, or health, as well as claims under the Product Liability Act. Liability for the breach of essential contractual obligations (cardinal obligations) is limited to the foreseeable, contract-typical damage.
7. Intellectual Property
The aincare app, the website, and all associated content (software, design, texts, graphics) are protected by copyright. You are granted a simple, non-transferable right of use for personal purposes. Reproduction, distribution, or making publicly available requires prior written consent. AI-generated responses to your inputs may be freely used by you for personal purposes.
8. Prices and Payment
Basic use of aincare is free. Additional features may be offered as paid subscriptions in the future. The respective prices will be transparently displayed before concluding a subscription. All prices are final prices. Due to the small business regulation pursuant to § 19 UStG, no VAT is charged or shown.
9. Contract Duration and Termination
The usage contract for free basic use is concluded for an indefinite period and can be terminated by either party at any time without giving reasons.
Paid subscriptions can be cancelled at the end of the respective term. Cancellation can be done via the settings in the app, by email to contact@aincare.de, or through the Google Play Store. Automatic renewal of paid subscriptions only occurs if this has been expressly communicated before conclusion of the contract and confirmed by the user.
Users can delete their account and all associated data at any time via the settings in the app. Deletion is irreversible. When deleting an account with an active subscription, the subscription cancellation remains unaffected — the subscription must be cancelled separately.
10. Right of Withdrawal
For paid contracts, consumers have a statutory right of withdrawal of 14 days. The complete withdrawal information and the model withdrawal form can be found at Right of Withdrawal.
11. Updates
In accordance with § 327f BGB, we ensure that the aincare app is provided with the necessary updates during the contract term. This includes security updates and functional updates insofar as they are required for the contractual use. We will inform you about available updates. If you do not install a provided update, we are not liable for defects that are solely attributable to the missing update.
12. Changes to Terms
aincare reserves the right to change these Terms insofar as this is necessary and the change is reasonable for you. Registered users will be informed of significant changes at least 30 days before they take effect via email or in-app notification. You have the right to object to the change within this period. In the event of an objection, either party may terminate the contract at the time the change takes effect. If you do not object, the new Terms apply from the communicated date.

14. Final Provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory provisions of the state in which they have their habitual residence additionally apply. For consumers, the general place of jurisdiction applies; for businesses, the place of jurisdiction is the registered office of aincare. If individual provisions of these Terms are or become invalid, the validity of the remaining provisions remains unaffected.
